THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

1. Our Legal Duty

Marielis Health & Wellness, LLC (“Marielis Health & Wellness,” “we,” “us,” or “our”) is required by law to:

  • Maintain the privacy of your Protected Health Information (PHI)

  • Provide you with this Notice of our legal duties and privacy practices

  • Follow the terms of this Notice currently in effect

We reserve the right to change this Notice and will make the revised Notice available upon request and on our website.

2. How We May Use and Disclose Your Health Information

A. Treatment

We may use and share your health information to provide, coordinate, or manage your healthcare.
Example: Sharing information with labs or pharmacies to prescribe medications or review test results.

B. Payment

We may use and disclose PHI to obtain payment for services provided.
This includes sharing information with payment processors (e.g., PayPal) as necessary for billing.

C. Healthcare Operations

We may use PHI for practice operations, including quality improvement, compliance activities, and administrative purposes.

3. Uses & Disclosures Without Your Authorization

We may disclose your PHI without your authorization in the following circumstances:

  • As required by law

  • Public health activities

  • Health oversight activities

  • Judicial or administrative proceedings

  • Law enforcement purposes

  • To avert a serious threat to health or safety

  • Workers’ compensation claims (as applicable)

4. Uses & Disclosures Requiring Your Authorization

We will not use or disclose your PHI for the following without your written authorization:

  • Marketing purposes

  • Sale of PHI

  • Uses beyond treatment, payment, or healthcare operations

You may revoke an authorization at any time in writing.

5. Electronic Health Records & Telehealth

We provide care exclusively via telehealth and maintain electronic medical records using OptiMantra.

Your PHI may be shared with:

  • Third-party laboratories

  • Compounding pharmacies (including peptides and weight management therapies)

  • E-prescribing systems

  • Other healthcare providers involved in your care

All such disclosures are limited to the minimum necessary and handled in compliance with HIPAA.

6. Communications (Email, Phone, SMS)

We may contact you via:

  • Phone calls

  • Email

  • Text messages (SMS)

  • Secure patient portals

These communications are primarily for:

  • Appointment reminders

  • Care coordination

  • Follow-up regarding treatment

SMS consent is not shared with third parties.

You may request alternative communication methods or restrictions at any time.

7. Your Rights Regarding Your Health Information

You have the right to:

  • Get a copy of your medical record

  • Request corrections to your medical record

  • Request restrictions on certain uses or disclosures

  • Request confidential communications

  • Get a list of disclosures of your PHI

  • Get a copy of this Notice

  • File a complaint if you believe your privacy rights have been violated

You will not be retaliated against for filing a complaint.
